These Terms and Conditions (“Terms”) apply to the Mode & Opal Monthly “Review & Win” Giveaway (“Giveaway”) run by Mode & Opal Limited (“the Promoter”, “we”, “us”, “our”). By entering, participants agree to be bound by these Terms.

1. Eligibility

1.1 The Giveaway is open to residents of New Zealand and Australia aged 18 years or older at the time of entry.

1.2 Employees of the Promoter and individuals directly employed by the Promoter are not eligible to enter.

1.3 By entering, participants confirm they meet all eligibility requirements.

2. How to Enter

2.1 To receive an entry into the Giveaway, participants must:

  a) Make a verified purchase of a Mode & Opal bottle; and

  b) Either:

  • Share a story on Instagram, tagging the official Mode & Opal Instagram account; or

  • Share a reel on Instagram featuring the Mode & Opal bottle, tagging the official Mode & Opal account.

2.2 Only one of the above actions (story or reel) is required for a valid entry.

2.3 Private Instagram accounts are permitted to enter.

2.4 Multiple entries are allowed if multiple stories or reels are posted during the calendar month, provided all posts meet the requirements in clause 2.1.

2.5 No hashtag is required for entry.

3. Entry Period

3.1 Each Giveaway period runs from 12:00am on the first day of the calendar month until 11:59pm on the last day of that month (“Entry Period”).

3.2 Entries received outside the Entry Period will not be included in the draw for that month.

3.3 A minimum of five (5) valid entries must be received for a monthly draw to occur.

4. Prize

4.1 One winner will receive $100 NZD, paid in New Zealand dollars.

4.2 The prize is paid via bank transfer or another method reasonably agreed between the winner and the Promoter.

4.3 The prize is not transferable, exchangeable, or redeemable for products or credit.

5. Selection of Winner

5.1 A winner will be chosen by random draw on the first business day of the following month.

5.2 The draw includes all valid entries from the previous month’s Entry Period.

5.3 The winner will be notified via Instagram direct message from the official Mode & Opal account within 48 hours of the draw.

5.4 The winner must respond to the notification within 48 hours to claim the prize.

5.5 If the winner does not respond within 48 hours, the Promoter may:

  a) select another winner; or

  b) determine that no prize will be awarded for that month.

6. Content Rights

6.1 By entering the Giveaway, participants grant the Promoter a non-exclusive, royalty-free, worldwide licence to use any tagged story or reel submitted as part of their entry for marketing, promotional or advertising purposes.

6.2 The Promoter may edit, adapt, repost, or reuse the content in any reasonable manner.

6.3 Participants confirm they have the right to grant these permissions.

7. Privacy

7.1 Participant names, Instagram handles and content will be used solely for administering the Giveaway.

7.2 The Promoter will not add entrants to any email marketing list.

7.3 The Promoter will not store participant details for more than three (3) months after the prize is awarded.

7.4 All personal information will be managed in accordance with New Zealand privacy laws.

8. General Conditions

8.1 The Giveaway is in no way sponsored, endorsed, administered by, or associated with Instagram.

8.2 Participants release Instagram from any liability arising from the Giveaway.

8.3 The Promoter reserves the right to:

  a) verify the validity of entries;

  b) refuse entries that do not comply with these Terms;

  c) modify, suspend or cancel the Giveaway at any time for any reason;

  d) amend these Terms where necessary.

8.4 The Promoter is not responsible for:

  a) late, lost or misdirected entries;

  b) technical issues affecting entry or contact;

  c) any failure by the winner to receive notifications due to privacy settings or other limitations.

8.5 These Terms are governed by the laws of New Zealand.
